UPDATE: Area Teacher's Aide Charged with Criminal Sexual Conduct

If convicted, Michelle Rose Chlan, 26, will likely face no more than seven years behind bars

If convicted of all three charges of third degree criminal sexual conduct, Michelle Rose Chlan, 26, will face just five to seven years behind bars, Dakota County Attorney James C. Backstrom told Patch today.

Chlan was charged yesterday on three counts of having a sexual encounter with a 16-year-old male student of the Shakopee school at which she taught.

According to the criminal complaint, Chlan performed oral sex on the student on three separate occasions between June 2009 and July 2010.

Minnesota statute 609.344 states clearly that the maximum penalty for each infraction on which Chlan was charged is 10 years' imprisonment and/or a $30,000 fine.

Backstrom explained that Minnesota sentencing guidelines dictate the penalty for this particular category of sex crime and that Chlan, if convicted, would likely face no more than seven years in prison.

Chlan is scheduled to be arraigned and receive her sentence on June 6.

Shakopee resident Michelle Rose Chlan, 26, was charged today with three counts of third degree criminal sexual conduct in connection with allegedly having sexual relations with a then-16-year-old male student.

Chlan worked as a paraprofessional at the school the student attended when the incidents occurred, according to a statement from Dakota County Attorney James Backstrom. 

Although the two met at a Shakopee school, the encounters occurred in Burnsville between June 2009 and July 2010, according to the statement.

“Crimes of this nature can have long-term emotional and psychological impacts on the minor victims involved," Backstrom said in the statement. 

According to the Dakota County Sheriff's Department website, Chlan was arrested March 28 and appeared this morning before Dakota County Judge Kevin Mark. 

According to a complaint filed by the Dakota County District Court, Chlan first denied the allegations of sexual encounters but, once presented with the evidence, admitted to the charges.  

If convicted, Chlan faces a maximum penalty of 15 years in prison and a $30,000 fine, according to the Minnesota statute.  

Mark set bail in the amount of $100,000 without conditions or $25,000 with conditions. Chlan paid bond and was released, provided she adhered to the conditions set forth by Mark.  

Chlan's arraignment is scheduled at 9 a.m. June 6.
