Local Man to Be Sentenced for Beating Woman, Throwing Chair Through Plate Glass Window

A former Burnsville resident will soon be sentenced for a rampage that left a female family member injured and parts of his mother's home destroyed.

David Bustos, Jr. pleaded guilty on March 22. The 21-year-old man was charged with domestic assault, damage to property, disorderly conduct and underage drinking after an incident in Lakeville on June 23, 2011.

That night, the Lakeville Police Department was called out to an address in the 5800 block of 177th Street after recieving reports of breaking glass and a woman screaming. When officers arrived just before midnight, they saw two bloodied men walking away from the area. One, identified as Bustos, appeared extremely intoxicated. A field test revealed that Bustos had a blood alcohol level of .224. Officers also noticed that his lip was swollen and bleeding and that he appeared to have abrasions on his right hand. However, Bustos refused to speak when questioned.

As they approached the house, police saw that a large picture window had been smashed out. Inside, officers spoke with a 16-year-old relative of Bustos who said the defendant had thrown a chair through the window and cut himself as he attempted to leave through it. In the living room, officers also found broken picture frames, China, pottery, and a mirror in addition to shattered glass from the window. All told, the damage was valued at $1,000.

The girl said Bustos came to visit at 1:00 p.m. and had been drinking beer and rum all through the afternoon and evening. At some point, the defendant became belligerent and told her to sit down on the couch. She told him to shut up and Bustos "lost control." According to the criminal complaint, he pushed her against a wall and began punching her in the head with a closed fist. The girl fled to her room and pinned the door shut. Bustos pursued her, kicking and punching at the door. Eventually, Bustos' mother persuaded her to open up. When she did, the defendant walked in, pushed her onto the bed and punched her until he was too tired to go on.

The attack seemed over until the girl went into the living room, where Bustos came at her again. This time, another man intervened, but Bustos attacked him as well. As a final gesture, Bustos tossed a chair through the window after he was told to leave.

Bustos' most recent address is in Farmington. His sentencing is scheduled for May 24. This is not his first brush with the law. In February, he was convicted of second-degree assault in Isanti County.
