Burnsville Woman Charged with DWI, Child Endangerment After Crash

A Burnsville woman has been charged with child endangerment, DWI and criminal vehicular operation after police say she crashed into another car last week with five children in her car.

Amy Yvonne Mullin, 30, faces four gross misdemeanor charges in connection with the Sept. 27 accident: child endangerment, criminal vehicular operation resulting in bodily harm and two counts of third-degree DWI.

According to the criminal complaint, Burnsville police were called to the vicinity of Evergreen Drive and Aston Circle just after 10:30 a.m. Sept. 27 to investigate a two-vehicle accident involving injuries. 

Police spoke to the driver of the second car, who said he was eastbound on Evergreen Drive when Mullin’s car turned in front of him. The man said his 5-year-old grandson was in the back seat of his car at the time of the accident, but the child was not injured.

An officer also spoke to Mullin and detected the odor of alcohol, along with her glassy, bloodshot eyes. He also noted that she was having difficulty following their conversation, according to the complaint.

Mullin initially told the officer that she had four children in her car at the time of the crash, ages 9 months old and 2, 4 and 5 years old. While police were still on the scene, another person walked over with a 7-year-old child, and Mullin admitted that the 7-year-old had also been in her car at the time of the accident, the complaint says.

Mullin said she lied to police because she knew the children had not been properly buckled in her car. She said the 7- and 5-year-old children were buckled in together in the front seat, according to the complaint.

The 7-year-old’s face was scraped during the accident. The scrape was treated with an ice pack.

Police said Mullin initially failed to properly recite the alphabet, but was successful on her second try. However, she failed a test in which she was asked to count backward.

Mullin’s blood-alcohol content registered .175 percent, more than twice the legal limit of .08 percent, on a preliminary breath test. A second test registered a .15 percent blood-alcohol content.

Mullin has been released from custody pending future court appearances and on the conditions that she have no contact with the victims and that she take prescribed medication as ordered. An omnibus hearing in her case is scheduled Jan. 14 in Dakota County District Court in Hastings.
