Burnsville Man Charged with Illegally Possessing Stun Gun, Pepper Spray

Police say Daniel James Boll had a stun gun and pepper spray in his pockets when they arrived to investigate a report of a domestic assault.

A Burnsville man convicted twice of felony drug possession has been charged with illegally possessing pepper spray and a stun gun.

Daniel James Boll, 29, is charged with unlawful possession of tear gas compound or electronic incapacitation device by a felon, a felony with a maximum penalty of five years in prison and a $10,000 fine.

Boll remains in the Dakota County Jail on a $50,000 bond. An omnibus hearing in his case is scheduled May 15 in Dakota County District Court in Hastings.

According to the criminal complaint, police were called to an apartment in the 12800 block of Nicollet Avenue South on April 17 on a report of a domestic assault involving a weapon. The caller told police that a man was standing in the hallway of the apartment building holding a knife, and that he and a woman in the apartment had been arguing for hours.

When police arrived, they allegedly found Boll standing in the hallway in front of his open apartment door, holding a kitchen knife, the complaint says. As officers approached, Boll put the knife in the back pocket of his pants; police told him to remove the knife and put it on the ground.

Boll was arrested, and police asked him why he had a knife. He told them he thought someone was trying to break into the apartment, according to the complaint.

Police searched Boll and found a stun gun and pepper spray in his pocket, the complaint charges. Boll told them he had found the items while cleaning the apartment, according to the complaint.

Boll admitted to police that the woman in his apartment before they arrived was his ex-girlfriend, who has an active protection order against him.

Boll was convicted of felony drug possession twice in 2004.
